Subject:Grant of Financial up gradation under Modified Assured Career Progression Scheme: DEOs.

A number of references are being received in HQr office, from Controller offices, regrading grant of financial upgradation under MACP Scheme to DEOs ‘A’ & ‘B’.

The matter has been examined and it is intimated that Hon’ble Supreme Court of India vide judgment dated 9.12.2014, on merger of pay scales of DEO ‘A’ and ‘B’, pronounced in Civil Appeal No. 10862/2014, arising out of SLP (C) No. 26977 of 2010, has clarified that DEO ‘A’ are not entitled for pay scale of Rs 1350-2200/- w.e.f. 1.1.1986 or thereafter, merely on the basis of their qualifications or for the fact that they have completed their period of requisite service. Accordingly, the Apex Court has held that the respondents i.e. DEOs are not entitled to the benefit as they sought for before the Tribunal or the High Court, all the impugned orders passed by the CAT Benches and the High Courts in favour of the respondents being illegal are set aside.
 

In view of the above development, the matter regarding grant of Pay scale to DEO ‘A’ has now been referred by EDP Wing of HQrs. office to the Ministry and on receipt of communication from the EDP Wing, the necessary directions in this regard will follow, to regularize the financial upgradation under MACP Scheme to DEOs, in light of DOP&T OM dated 19/05/2009 at your end.
 

Further, it is also advised to bring the Apex Court judgment dated 9.12.2014, down loaded from the Supreme Court website, to the notice of Hon’ble Court/ CAT through Government Counsel, wherever the subject case is due for hearing.
